1. Definitions

In these terms, the following definitions apply:

Service Provider: L3-Sports / Endurix.cc, located at Spinnewiel 3, 7641 LX, Wierden, The Netherlands.
User/Customer: any natural person or legal entity using the services of Endurix.cc.
Agreement: any arrangement between the Service Provider and the Customer concerning the delivery of services and/or products.
Services: the online platform services, including training plans, coaching functionalities, and other products as described on Endurix.cc.

2. Applicability

These terms and conditions apply to all offers, agreements, and deliveries of the Service Provider, unless otherwise agreed in writing. The Customer's own terms and conditions are explicitly rejected.

3. Services

The Service Provider offers digital services through Endurix.cc, including the generation of training plans and coaching advice. The scope of the services depends on the subscription or package chosen.

4. Account and Use

To use the services, the Customer must create an account.
The Customer is responsible for the accuracy of the information provided and for keeping login details confidential.
Misuse of accounts or violation of these terms may result in termination of access.

5. Prices and Payment

All prices are stated in euros and include VAT, unless otherwise specified.
Payment must be made in advance using the payment methods offered by the Service Provider.
In case of late payment, the Service Provider reserves the right to suspend or terminate access to the services.

6. Term and Termination

Subscriptions are entered into for the agreed period (e.g., monthly/annually) and, unless otherwise specified, are automatically renewed.
Cancellation must be made in accordance with the notice period indicated in the Customer's account.
The Service Provider may terminate the agreement immediately if the Customer acts in violation of these terms or the law.

7. Intellectual Property

All intellectual property rights relating to the services, software, texts, and materials remain the property of the Service Provider or its licensors. The Customer is not permitted to reproduce, distribute, or make public any materials from Endurix.cc without prior written consent.

8. Liability

The Service Provider strives to provide careful and correct services but does not guarantee that the services will always be uninterrupted or error-free.
The content of training plans and advice is intended as a tool; the Customer remains responsible for its application.
The Service Provider's liability is limited to the amount paid out by its insurance or, if no insurance applies, to the invoice amount of the last month.
The Service Provider is not liable for indirect damage, consequential damage, or lost profits.

9. Force Majeure

The Service Provider shall not be obliged to fulfill any obligation if prevented from doing so by circumstances beyond its control (including but not limited to network or hosting failures, illness, or government measures).

10. Complaints and Disputes

Complaints may be submitted via info@endurix.cc. The Service Provider aims to respond within 14 days.
These terms and conditions are governed exclusively by Dutch law.
Disputes arising from this agreement will be submitted in the first instance to the competent court in the district where the Service Provider is established.

11. Changes

The Service Provider reserves the right to amend these terms and conditions. The most current version is always available on Endurix.cc.
